Mediation

It can be difficult for people with little time or financial resources to reach a fair settlement of their case, as the law has traditionally consisted of long and expensive formal processes; hence the popularity of new methods of Alternative Dispute Resolution, of which mediation is one.

Using mediation allows both parties to give their own input directly and to hopefully reach an agreement without the associated time, expense and formality of going to court.

A trained mediator acts as a third party who sits in on 'hearings' taking statements from both sides and whose overall aim is to encourage both parties to reach a compromise that is beneficial to them.

Parties can choose the mediator themselves, or if they prefer, can appoint a mediator from an organisation, so impartiality cannot be questioned.

Mediation is most commonly used for issues surrounding family law, and building disputes. A mediator will be an expert in the area of dispute being heard and will have knowledge of the relevant law in question.

If you do use mediation, it is still possible to appoint your own solicitor to put forward your concerns, and advise you before any agreement is made.
